Regulations for the "Mercantile Smile" benefits program by Mercantile Discount Bank Ltd. The benefits program from Mercantile Discount Bank Ltd (hereinafter: "the Bank" or "Mercantile"), namely "the Mercantile Smile program" (hereinafter: "the benefits program" is the Bank's dedicated benefits program, in which framework benefits and discounts are given by various retailers to the Bank's clients, holders of credit cards issued by Mercantile. The benefits and discounts will be offered from time to time by retailers participating in the program, whether at the point of purchase or the time of billing, and all in accordance with the judgment of the bank and in accordance with the bank's advertising as regards the program and the benefits included in it. The list of retailers who provide, in the framework of the benefits program, the benefits is detailed on the website of the program and the Bank is authorized to change and update the list at any time and without advance notice. Membership in the benefit program – Clients of the bank who hold bank credit cards issued by the Bank are automatically entered into the "Mercantile Smile" benefits program and are eligible for the benefits included in it. It shall be clarified that membership in "Mercantile Smile" does not involve payment. Manner of provision of the benefits – The program combines the following types of benefits: Benefits at the time of billing – Clients pay full price for the product/service at the point of purchase at the retailer and the benefit is given at the time of billing and displayed on their credit card's monthly statement. For example: the cost of the product is 100 NIS and a 10% discount is given at the time of billing. Clients shall pay 100 Nis at the retailer and be charged in actuality 90 Nis, as reflected in the statements. In cases where the retailer is affiliated with other benefits programs in which discounts are given at the time of billing, clients will be eligible for the higher of the two discounts at the time of billing. In such cases, clients will not be eligible to combine the discounts. It shall be clarified that the discount does not replace other discounts given by the retailer for purchases, whether discount offers or other forms of discounts, but is added to them (for example: end-of-season sales.) Benefits at the time of purchase – Clients pay the reduced price at the point of purchase at the retailer, contingent on payment with the credit card of the bank associated with the program and contingent on the client's presenting identification as a client of the Bank/presentation of the coupon code. Information about discounts/benefits is displayed on the program site/the Bank's site and in the Bank's various advertisements. Benefits which are not monetary benefits – It shall be clarified that in the framework of the program, retailers shall be authorized, based on the Bank's judgment, to offer clients non-monetary benefits, such as a free item at the time of purchase at the retailer; this shall be in accordance with the conditions which were published in the program's advertising. The benefits and discounts in the program are managed by "Dolce Vita" Co., including all issues related to the marketing issues of enlisting benefits from retailers. Manner of redemption of benefits at retailers – Benefits shall be given directly by retailers in accordance with the instructions that shall appear in advertising dealing with that benefit and in accordance with these regulations. Manner of display of the benefit in monthly statement – It shall be clarified that the benefits in the "Mercantile Smile" program shall be given for NIS transactions made with the credit card affiliated with the program and for USD transactions converted to shekels only, subject to their being carried out at participating retailers. In case of transactions which are paid in installments/credit transactions at one of the retailers participating in the program, the benefit shall be made visible at every single payment. With the cancellation of a transaction to be billed in which the discount is given at the time of billing in the framework of the said program, the client's account shall be refunded for the transaction, minus the amount of the discount that was given (this means that the client shall be refunded only for the sum he or she paid after the discount.) Liability – The Bank and/or Dolce Vita Deal Co. and/or Cal Israel Credit Cards Ltd., (which jointly issues and operates the Bank's cards), are not liable for the quality of the product and/or the activity and/or the service and/or the benefit. The responsibility for this is solely the retailers'. For the sake of the removal of doubt, it shall be clarified that the Bank and/or Dolce Vita Deal Co. and/or Cal Co. shall not have any direct and/or indirect liability in connection with the product and/or the activities and/or the service and/or the benefit, as said above. Every purchase of a product and/or service and/or activity by the client in the framework of the program is at the sole responsibility of the client and the retailer offering the benefit. It shall be clarified that nothing in the program or its advertising constitutes an offer, solicitation, or direction to perform a transaction at the retailer or redeem the benefit in the framework of the program and that the Bank and/or the Dolce Vita Co and/or Cal Co. should be seen as soliciting and/or directing and/or offering. The pictures depicting the benefits in the various advertisements are the sole responsibility of the retailers and are for illustrative purposes only. Visits to the websites of the retailers participating in the program does not impose liability on the Bank and/or Dolce Vita Co and/or Cal Co as to the contents and the advertisements which appear there and they are the sole responsibility of the retailer. If disruptions or malfunctions are found on the benefit program's website despite the efforts of the Bank and/or Dolce Vita Co's efforts to prevent them, the Bank and/or Dolce Vita shall not be liable for any damages or losses incurred as a result. The period of the program – The benefits program shall start from March 1, 2015 and end on the date announced by the Bank. It is clarified that the advertisements of the lists of retailers participating in the program, the benefit rate, the type of benefit it grants, the manner in which the benefit is granted, are contingent on the judgment of the Bank and subject to change by it at any time. Reception of marketing messages related to the benefit program – Clients who have given their consent to receive advertising information from the Bank shall received advertisements on the benefits offered in the program from time to time to the email address they provided or in text messages to the cellphone number they provided. If clients should ask to stop receiving advertising information, they are entitled to do that at any time in the manner outlined in the advertising information.
